API Terms of Use

1. INTRODUCTION AND SCOPE

These API Terms of Use (the “API Terms”) govern your access to and use of the developer API operated by Webnetic s. r. o. (“NTPrices”, “we”, “us” or “our”) at ntprices.com, described at /developers and documented at /developers/api-docs (together, the “API”). The API is a self-service, key-based product: you request an API key, and your continued use of the API is subject to these API Terms from the moment you first use that key, whether or not you were asked to click “I agree” anywhere in the request process.

These API Terms are supplemental to, and incorporated by reference into, our main Terms of Use, which continue to apply to your use of the Site generally (including your Account, if you have one). Where these API Terms and the main Terms of Use both address a point relevant to your use of the API, these API Terms control for that specific point; on every other matter, the main Terms of Use, our Privacy Policy and our Copyright Policy continue to apply in full. If you do not agree to these API Terms, you must not request, activate or use an API key.

2. DEFINITIONS

In addition to the definitions in section 2 of our main Terms of Use, the following terms have the meanings set out below wherever they are used in these API Terms:

  • “API” or “API Services” means the programmatic HTTP endpoints we make available under ntprices.com (including the current v2 endpoints under /api/v2/ and the legacy v1 endpoint at /api.php), together with any associated self-service tooling such as the developer dashboard and the account-management endpoints (GET /account, GET /account/usage, PUT /account/regions).
  • “API Key” means the unique credential we issue to you that authenticates your requests to the API, ties those requests to your plan, quota and allowed regions, and is used to attribute usage of the API to you.
  • “Developer”, “you” or “your” means the individual or organisation that requested an API Key, and includes anyone you permit to use it on your behalf, such as an employee, contractor or co-founder.
  • “API Data” means any pricing, catalogue, availability, sale, history or related data returned by the API in response to a request, including current and historical eShop prices, deal and discount information, and metadata about games, publishers, developers and sale campaigns.
  • “Documentation” means the technical documentation for the API published at /developers/api-docs and the plan/pricing information published at /developers, each as updated by us from time to time.
  • “Plan” means the tier associated with your API Key (currently Free, Indie, Pro or Business, or any successor tier we publish), which determines your monthly request quota, allowed regions, page sizes, price-history window, commercial-use rights and attribution requirement, as set out in the Documentation and subject to change as described in section 9.

3. ISSUANCE AND SECURITY OF YOUR API KEY

You may request an API Key by e-mailing us at [email protected] with your project and the Plan you want, or through the request flow on your developer dashboard. We review requests before issuing a key and may decline to issue one, or may issue a key on a different Plan than requested, at our discretion — for example where the stated use case is unclear, appears to conflict with these API Terms, or where we are unable to verify the requester. Once issued, most day-to-day management of your key is self-service and does not require a website Account: GET /account shows your Plan, quota, expiry and allowed regions; GET /account/usage shows your recent request history; and PUT /account/regions lets you change which store regions your key serves, subject to the limits and cooldown described in the Documentation.

Your API Key is a credential, not merely a label: anyone who has it can make requests, consume your quota, and access API Data as you. You are solely responsible for keeping your API Key confidential and for all activity that occurs through it, whether or not you authorised that activity. Do not embed your API Key in client-side code, public repositories, mobile app binaries, or any other location where it could be extracted and used by a third party; where your integration has an untrusted client (such as a browser or mobile app), proxy API requests through your own backend so the key itself is never exposed. You agree to notify us promptly at [email protected] if you believe your API Key has been compromised or leaked, and we may rotate, suspend or revoke a key at any time, without notice, where we reasonably believe it has been compromised, is being used from an unexpected or abusive pattern of traffic, or is otherwise implicated in a violation of these API Terms — including the multi-key/multi-account abuse safeguards we apply to Free-plan keys, described in the Documentation. We are not liable for any loss or damage arising from your failure to keep your API Key secure.

4. ACCEPTABLE USE

You may use the API and API Data to build applications, sites, dashboards, analytics tools and user-facing alerts, subject to your Plan and to these API Terms. Without limiting the acceptable-use restrictions in section 5 of our main Terms of Use, which also apply to your use of the API, you agree that you will not, and will not permit or assist any third party to:

  • redistribute, resell, sublicense, publish or otherwise make available API Data in bulk or in substantially raw form to any third party as a standalone dataset or feed, whether for payment or free of charge, without our prior written permission;
  • use the API or API Data to build, operate or materially support a product or service that directly competes with NTPrices as a price-tracking, deal-comparison or price-history service for the Nintendo eShop or similar storefronts;
  • bulk-archive, mirror or systematically retain API Data beyond what your Plan’s request quota, page sizes and price-history window are designed to permit, or use repeated, systematic API requests as a way to reconstruct a broader archive than your Plan allows;
  • use the API, or scrape, crawl or otherwise access the public Site, to work around a limit that applies to your Plan, including your monthly quota, allowed regions, page sizes, price-history window, or the per-minute burst limit described in the Documentation;
  • present yourself, your application, or your service as NTPrices, as an official or endorsed source of eShop pricing, or as affiliated with Nintendo, or otherwise misrepresent the origin of API Data you display, in each case without the attribution your Plan may require (see below) or in a way likely to mislead your own users about where the data comes from;
  • send an excessive, automated or disproportionate volume of requests to the API, attempt a denial-of-service or denial-of-wallet style pattern of traffic, or otherwise place an unreasonable load on our infrastructure, whether or not such traffic would technically fit within your quota;
  • circumvent, disable or interfere with rate limiting, authentication, region controls or any other technical measure we use to meter or control use of the API, including by rotating IP addresses, creating or using multiple Accounts or API Keys to multiply a single Plan’s quota, or spoofing request headers;
  • use the API for any unlawful purpose, or in a way that infringes the intellectual property, privacy or other rights of NTPrices, Nintendo, or any other third party.

Where your Plan requires attribution, you must display “Powered by NTPrices” (linking to https://ntprices.com) in a reasonably visible place wherever API Data appears in your product; the Documentation states which Plans currently require this. Commercial use of the API — broadly, any use in a product or service that generates revenue, is offered to customers, or supports a business — requires a paid Plan; the Free Plan is offered for evaluation and non-commercial projects only, and using it commercially is a violation of these API Terms. You are responsible for honouring your Plan’s rate limits, and should cache API Data in your own systems rather than re-requesting the same data. We reserve the right to investigate suspected violations of this section and to take technical measures — including throttling, rate-limit tightening, and suspension or revocation of your API Key — to prevent or stop them, in each case without prior notice where we reasonably believe it is necessary to protect the API, other Developers, or third parties.

5. OWNERSHIP OF API DATA

API Data reflects pricing, catalogue and availability information drawn from publicly accessible sources operated by third parties, principally the Nintendo eShop. We do not create the underlying prices or catalogue listings themselves; we collect, structure, store and, where indicated, annotate this information (for example, computing deal scores, price-history series and sale-campaign groupings) through automated and periodic processes. The compiled, structured form of API Data — as opposed to the underlying third-party facts it reflects — is part of our Content and is protected as described in section 7 of our main Terms of Use; your right to use it is limited to what these API Terms and your Plan permit, and no other right, title or interest in API Data is transferred to you.

API Data is provided “as is” and without warranty of any kind as to its accuracy, completeness, currency or fitness for any purpose. Prices, discounts, availability, currency conversions and deal assessments are collected periodically and may be delayed, incomplete, regionally inconsistent, or no longer accurate by the time you receive or display them; API Data does not constitute an offer to sell or a binding quotation, and end users of any application built on the API should always verify the current, final price and availability directly on the Nintendo eShop (or the applicable third-party retailer) before completing a purchase. “Nintendo”, “Nintendo Switch”, “Nintendo eShop” and related names, logos, game titles, cover art and descriptions returned as part of API Data belong to Nintendo and the relevant publishers, developers and rights holders; you may use them solely for identification, reference and comparison purposes consistent with your use of the API, and such use does not imply any relationship, sponsorship or endorsement between Nintendo and you or us.

6. SERVICE AVAILABILITY

We aim to keep the API available and performant, but we do not guarantee, and these API Terms do not include, any service-level commitment or uptime warranty. The API may be unavailable, degraded, rate-limited or return incomplete data from time to time as a result of maintenance, upstream data-source issues, capacity constraints, security measures, or factors outside our reasonable control. We may perform maintenance, deploy changes, or take the API (or specific endpoints) offline temporarily, with or without advance notice, and we will use reasonable efforts to give advance notice of planned maintenance likely to cause a material outage where practicable. We may also change, deprecate or retire an API version or endpoint over time — for example, the legacy v1 endpoint (/api.php) is deprecated in favour of v2 and scheduled for retirement, as announced in the Documentation — and will use reasonable efforts to give advance notice before retiring an endpoint that remains in active use.

7. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, the API and all API Data are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the API will be uninterrupted, timely, secure or error-free, or that API Data is accurate, complete, current or reliable. In no event will we, our officers, employees or agents be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity or other intangible losses, arising out of or related to your access to or use of, or inability to access or use, the API, whether based on warranty, contract, tort (including negligence), statute or any other legal theory, and whether or not we have been advised of the possibility of such damages. Without limiting the foregoing, we are not liable for any loss arising from incorrect, delayed, incomplete or outdated API Data, from API downtime or rate-limiting, or from any decision made or action taken by you or your end users in reliance on API Data.

To the fullest extent permitted by applicable law, in no event will Webnetic s. r. o., its officers, employees or agents be liable to you for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, business interruption, or other intangible losses, arising out of or in connection with your access to or use of, or inability to access or use, the API or any API Data. Nothing in these API Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation. Nothing in this section is intended to limit any rights you may have as a consumer under the mandatory law of your country of residence that cannot be waived by agreement.

8. TERMINATION AND SUSPENSION OF ACCESS

We may suspend, throttle or revoke your API Key, in whole or in part, at any time and with or without prior notice, if we reasonably believe you have violated these API Terms or our main Terms of Use, exceeded or attempted to circumvent your Plan’s limits, used the API in a way that creates risk, security concern or legal exposure for us or for other Developers or Users, failed to pay applicable charges for a paid Plan, or where we are required to do so by law. Where practicable and where we do not reasonably believe immediate action is necessary to protect the API or third parties, we will try to give you advance notice and a reasonable opportunity to fix the issue before revoking your key outright.

We may also discontinue the API, a Plan, or any specific endpoint or feature of it, at any time, for operational, legal or business reasons, and will use reasonable efforts to give advance notice as described in section 6. You may stop using the API, or ask us to deactivate your API Key, at any time by e-mailing [email protected]. Sections 5 (Ownership of API Data), 7 (Limitation of Liability), this section, and any provision of these API Terms or the main Terms of Use that by its nature should survive termination, will survive any suspension, revocation or termination of your API Key or access to the API.

9. CHANGES TO THESE API TERMS

We may revise these API Terms, and may change Plan details such as quotas, allowed regions, page sizes, price-history windows, attribution requirements and pricing, from time to time to reflect changes to the API, our practices, or for legal, regulatory or operational reasons. When we revise these API Terms, we will update the “Last updated” date at the top of this page; where reasonably practicable, we will also try to give advance notice of a material change — such as a Plan change that reduces your quota or removes a feature you use — through a notice in the Documentation, on your developer dashboard, or by e-mail where we hold your address. Your continued use of the API after a revised version of these API Terms takes effect constitutes your acceptance of the revised terms; if you do not agree, you must stop using the API and may ask us to deactivate your key as described in section 8.

10. GOVERNING LAW

These API Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), are governed by and construed in accordance with the law of the Slovak Republic, without regard to its conflict-of-laws principles, and the courts of the Slovak Republic will have exclusive jurisdiction to settle any such dispute or claim — consistent with, and without limiting, the governing-law and dispute-resolution provisions of section 15 of our main Terms of Use, including the protection those provisions preserve for consumers under the mandatory law of their country of habitual residence.
